Driving School Terms and Conditions

Introduction

The contract for driving tuition is solely between you and your instructor who is a self-employed franchisee of ProScot Limited.

These terms and conditions apply to that contract.

PROSCOT DRIVING SCHOOL LIMITED ARE NOT PARTY TO THAT CONTRACT. THEY ARE ONLY MENTIONED IN THESE TERMS AND CONDITIONS WHERE THEY ACT AS AGENT FOR YOUR INSTRUCTOR.

All driving lessons and courses are operated by ProScot Driver Training, trading as ProScot Limited, whose registered office is Barclay Court, Carberry Road, Mitchelston Ind Est ("ProScot Rider Training" / "We"). The "Pupil(s)" / "You" is / are the person(s) confirmed on the course confirmation letter. "Force majeure" is any situation beyond the control of ProScot Driver Training Ltd, which can be, but is not limited to, war, terrorist activity, natural disaster, civil strife, adverse weather or road conditions, fire, bureaucratic obstacles, changes in schedules by the Driver and Vehicle Standards Agency ("DVSA").

ProScot Driver Training reserves the right to decline any booking at their discretion. The Pupils(s) are required to sign a copy of the terms and conditions and a release and waiver form.

Variation of the terms of this contract is only valid if done so in writing and signed by both the Pupil(s) and an authorised representative of ProScot Driver Training. The contract and all matters arising from it are subject to Scottish law and the exclusive jurisdiction of the Scottish Courts. In the event that any of the provisions of this contract shall be determined by any Court to be invalid, unlawful or unenforceable to any extent then such provision shall to that extent be severed from the remaining provisions of the contract, which shall continue to be valid and enforceable.

Driving is potentially hazardous. You should be aware of this. We will take all reasonable precautions to ensure your safety whilst you are learning with us, however you should also do your best to prevent injury or accident to yourself or others. Do as your instructor tells you. If you are unsure about anything get it clarified before carrying on.

General Rules and Information General Conduct

Your ProScot Instructor is bound by a professional code of conduct, which ensures that all ProScot instructors will be polite, tidy and will not smoke in the car while giving tuition. They behave in a correct, professional and ethical manner at all times. ProScot Driving Tuition aims to provide you with the highest quality tuition at competitive prices in accordance with the Driving and Vehicle Standards Agency requirements and professional Code of Conduct.

ProScot Instructors are self-employed and are licensed to use ProScot's successful training formula.

Qualifications

The Driver and Vehicle Standards Agency (DVSA), part of the Department for the Environment, Transport and Regions, is the agency that examines, licences and controls the standards of all driving instructors in the UK. Your ProScot Driving Instructor is registered with the DSA and is approved by them to display the Approved Driving Instructor (ADI) badge on his/her car in addition they are specially trained in the correct way to deliver the ProScot Training Formula to ensure that you learn more in each lesson.

Vehicle

Your ProScot Driving Instructor gives your tuition in his/her car, which is properly insured for this purpose and for use in driving tests. The car is fitted with dual controls, is correctly maintained, and clean and tidy at all times.

ProScot Training Package

ProScot strongly believes that in order to learn effectively all lessons must be structured to suit individual needs. It is for this reason that ProScot offer a package of training to minimise costs whilst ensuring our students receive the highest quality tuition. Students can be loaned a Home Study Pack for a hire fee. This pack must be returned within 1 month, or an additional hire charge may become payable. Computer training on the latest version of the DVSA Theory Test CD ROM is free. Theory preparation is also available via our website.

Your Legal Requirements

At the start of your first lesson your instructor will ask you to sign a form stating that you have read and understood the 'Terms of Business, General Rules and Information.' He will also check your Provisional Licence and carry out an eyesight check (ensuring you can read a car registration plate at a minimum of 20.5 metres old style number plate or 20m for the new style. Your attention is also drawn to your responsibilities under the Road Traffic Act concerning the use of alcohol and drugs. Please ensure you present yourself in a fit and proper state!

Progress Reports

ProScot's unique training formula linked with your home study pack ensures you will maximise your learning potential. All lessons systematically work through all training phases and your progress is recorded. Feedback at each stage will ensure that you are fully aware of your strengths and weaknesses.

Bookings

Initial enquiries and bookings are either made via ProScot's online booking or contact form, or through Head Office on 01592 650100 (Monday to Friday 9:00am to 5.00pm and Saturday 10:00am - 2:00pm). An answering machine service is also available out with these hours. Your instructor will call to make a booking within 12 hours of your initial enquiry to arrange a suitable time for your first lesson. Thereafter bookings will be made directly with your instructor at the end of each lesson. It is in your best interest to book lessons 3 or 4 weeks in advance to avoid the disappointment of the times most convenient to you being booked by other pupils.

Lesson Start Times

Your ProScot Driving Instructor will make every effort to meet you at the start of the time booked for your lesson. However, this is dependent upon traffic conditions. You are asked to be prepared to start 10 minutes earlier or later than the time booked. Irrespective of the time of arrival of your ProScot Driving Instructor, the full lesson time will be given.

Cancellations

Please give the Head Office and/or your instructor as much notice as possible should you have to cancel or change a lesson. As your ProScot instructor is self-employed, should she/he be unable to re-book a lesson with another pupil, she/he personally loses income. You will be charged for a cancelled lesson if less than 48 hours' notice is given. Exceptional circumstances will be considered at the instructor's discretion.

Theory and Driving Tests (Car)

Both theory and practical tests are booked by yourself, and in some cases your instructor, who will advise you of telephone numbers and a suitable time and date. Driving test bookings take preference over lessons; if your lesson time needs to be changed your instructor will let you know as soon as possible. Your ProScot instructor will reserve a warm-up lesson, duration variable, and 1 hour for your test. Tests and bookings are carried out by the DVSA, thus your ProScot Instructor cannot be held responsible for any cancellations or postponements. He/she will help you to reclaim any out of pocket expenses you have lost as a result of cancellations

Payments

Individual lesson payments should be made direct to your ProScot Instructor by cash or cheque (with a cheque card). Cheques should be made out to the Instructor. Advance payments for courses can be made to your Instructor (please ensure you obtain and retain your receipt for your own records). Payments can also be taken on behalf of an instructor direct to the Pro - Scot office. Please note that your instructor is self-employed and operates under a ProScot franchise. Any problems regarding payments should be made directly to your instructor and not the ProScot office. ProScot act only as an agent for their instructors.

Please note any deposit or any subsequent training fees paid are not refundable in the event that you decide to cancel the training once the booking has been accepted by your local ProScot instructor. At this point a binding agreement is made between yourself and the local ProScot instructor. This does not in any way affect your statutory rights to be provided with the goods and services you have bought. Please also note that a full refund will be given if the ProScot Office or your local ProScot instructor is unable to meet any special requirements noted.

Customer Care Payment Protection Scheme

When you pay money direct to the ProScot Booking Office it is held in the ProScot Instructors' clients holding account. This money is being held on behalf of you and the ProScot Instructor. This money is not normally passed onto the ProScot instructor until the learner signs a form instructing the booking office to do so in part or in full. At various points during the training, the ProScot instructor will ask the learner to sign a form confirming their satisfaction with any training given. The learner should not sign this form unless they are totally satisfied with the training and want the office to pass on sufficient money held in the clients account to cover the training time authorised.
To ensure that each ProScot instructor provides services to the same high standards all the ProScot instructors have agreed that the ProScot Booking Office should also act as an arbitrator and withhold any money in the clients account in the event of a complaint. Only when this matter is resolved to the satisfaction of the ProScot instructor franchise Quality Control Director will payment be passed on or refunded as the case may be. In this way, the standards of the franchise can be maintained and you can be assured that you get what you pay for. Please note if you book directly with your ProScot instructor this scheme is not operated unless specifically requested and agreed by your ProScot instructor and confirmed by the ProScot Booking Office.

Lesson Postponement

Provided the ProScot instructor can easily obtain additional work for any individual lessons postponed no penalty will be incurred. If this is not possible the full training fee for the period in question may, at the total discretion of the ProScot instructor, be lost or charged. Your ProScot instructor reserves the right to postpone lessons if he or she feels that the weather or road conditions are unsuitable or dangerous. The ProScot instructor cannot be held responsible for any costs incurred as a result of him or her having to postpone any lessons, for whatever reason.

Junior Driver (Terms & Conditions)

  • We reserve the right to refuse instruction to anyone who turns up under the influence of alcohol, drugs or in an unfit state to drive. No refund or re-schedule would be offered
  • All ProScot Junior Drive sessions, must be paid on booking
  • School and youth group sessions are priced individually, must be paid before sessions begin and, once the booking is confirmed, cannot be cancelled
  • All bookings must be made directly with the office by telephone
  • ProScot Junior Drive is subject to availability. In the event of unforeseen circumstances, we reserve the right to change times or dates booked
  • We will endeavour to meet specific requests but we cannot guarantee that a student will have the same instructor for all ProScot Junior Drives
  • Late Arrivals
    ProScot Junior Drive runs to a tight schedule. Arriving 15 minutes late or more for an appointment may result in a lesson being forfeited - Latecomers will not receive extra time at the end of their allotted booking

Cancellations

  • Should you require to cancel or re-schedule your booking, five clear days' notice must be given or a loss of fee will be incurred
  • We are unable to refund or re-schedule in the event that you do not give the required notice or if any kind of illness or accident prevents your attendance
  • Failure to keep a booking without prior notification will automatically result in loss of fee

Vouchers/ ProScot Junior Drive Gift Packs

  • ProScot vouchers are valid for twelve months from date of purchase and can also be used for lessons with ProScot driving or motorcycling lessons
  • It is possible to transfer vouchers or lesson/s to another person but we are unable to redeem for cash

Complaints

This is a contract between yourself and your Driving Instructor. Should you have any complaints or are not happy in any way with your training, or any other part of our service, these matters should be taken up direct with your Instructor. However, please do not let a problem linger. If you booked your course or lessons through the ProScot Booking Office you may contact the person who arranged your training in the first place for advice and help by ringing 01592 650100. If you booked directly with the ProScot Instructor you will need to put your complaint in writing to ProScot Ltd, Barclay Court, Carberry Road, Mitchelston Industrial Estate, Kirkcaldy, Fife, KY1 3WE. Should he/she or the ProScot Booking Office be unable to resolve the issue and if you are still unsatisfied with the outcome, your complaint should be made in writing direct to the Driver and Vehicle Standards Agency or Trading Standards. The address will be available from your driving instructor, the ProScot office or online.

ProScot Ltd reserves the right to change prices, and details of products and services (and any offers) posted online without notice. All products and services are subject to availability and we give no guarantee in this regard. The provision of details of products and services on this website are not, and should not be construed as, an offer to sell or buy such products or services. ProScot Ltd may accept or reject your offer at its sole discretion.

Your Statutory Rights

Nothing in these terms and conditions will reduce your statutory rights relating to faulty or mis-selling of goods or services provided. ProScot Instructors have a statutory obligation to provide you with goods and services fit for the purpose for which they were bought and as described. Similarly, any goods supplied by the ProScot Booking Office must also be fit for the purpose for which they were bought and as described.
